Confidentiality<\/p>\n<ul>\n<li>Compliance with applicable data protection laws (e.g., Kenya Data Protection Act, 2019) and<\/li>\n<\/ul>\n<p>FAWE privacy requirements.<\/p>\n<ul>\n<li>Data Processing Agreement readiness; data localization, retention, deletion on request.<\/li>\n<li>Secure handling of personal and trip data; breach notification procedures.<\/li>\n<\/ul>\n<ol>\n<li>k) Sustainability Practices<\/li>\n<\/ol>\n<ul>\n<li>Availability of hybrid\/electric vehicles; options to prioritize low-emission rides.<\/li>\n<li>CO\u2082 reporting and reduction targets; carbon offset programs (if any).<\/li>\n<li>Fleet or operational initiatives that reduce environmental impact.<\/li>\n<\/ul>\n<p>4) Deliverables (Vendor Submission)<\/p>\n<ol>\n<li>Technical Proposal addressing the scope above, including:<\/li>\n<\/ol>\n<p>o Approach to safety, technology, account management, and service delivery.<\/p>\n<p>o Fleet details and coverage.<\/p>\n<p>o Data protection and information security controls.<\/p>\n<p>o Sustainability plan and metrics.<\/p>\n<ol start=\"2\">\n<li>Financial Proposal with:<\/li>\n<\/ol>\n<p>o Detailed fare structure and all fees.<\/p>\n<p>o Corporate discounts; any tiered pricing by volume.<\/p>\n<p>o Payment terms and invoicing model.<\/p>\n<ol start=\"3\">\n<li>Evidence of Experience providing corporate transport solutions (case studies\/summary).<\/li>\n<li>References from at least three (3) corporate clients (name, contact, engagement scope).<\/li>\n<li>Certificates\/Licenses &amp; Insurance (copies of valid licenses and insurance policies).<\/li>\n<li>Draft Service Level Agreement (SLA) with proposed KPIs and penalties\/credits.<\/li>\n<li>Signed Compliance Declarations (see Annexes).<\/li>\n<\/ol>\n<p>5) Contract Duration &amp; Implementation<\/p>\n<ul>\n<li>Initial Term: 12 months from contract signature, renewable subject to satisfactory<\/li>\n<\/ul>\n<p>performance and value for money.<\/p>\n<ul>\n<li>Implementation Timeline: Account setup, onboarding, and go-live within 2\u20134 weeks of<\/li>\n<\/ul>\n<p>award.\u2022 Transition\/Exit: Provider to furnish ride data exports, outstanding reports, and assist in<\/p>\n<p>orderly transition at contract end or termination.<\/p>\n<p>6) Service Levels &amp; Key Performance Indicators (KPIs)<\/p>\n<p>The provider must commit to SLAs with performance reporting and remedies. FAWE proposes the<\/p>\n<p>following minimum KPIs:<\/p>\n<ul>\n<li>Average Pickup Time: \u2264 10 minutes in primary service areas during business hours.<\/li>\n<li>Booking Fulfilment Rate: \u2265 98% (completed vs. requested rides).<\/li>\n<li>Cancellation Rate (Driver-initiated): \u2264 2% monthly.<\/li>\n<li>Platform Uptime: \u2265 99.5% monthly.<\/li>\n<li>Complaint First Response Time: \u2264 1 hour (24\/7).<\/li>\n<li>Complaint Resolution Time (non-critical): \u2264 24 hours; critical incidents: immediate<\/li>\n<\/ul>\n<p>containment and report within 2 hours, full report within 48 hours.<\/p>\n<ul>\n<li>Vehicle Standards: 100% compliance with roadworthiness; average fleet age \u2264 8 years (or<\/li>\n<\/ul>\n<p>better).<\/p>\n<ul>\n<li>Driver Vetting: 100% of active drivers fully vetted and licensed.<\/li>\n<li>Reporting Timeliness: Monthly reports submitted by the 5th business day.<\/li>\n<li>Data Requests: Data export or deletion requests fulfilled within 5 business days.<\/li>\n<\/ul>\n<p>Remedies: Service credits or other penalties to be agreed in the SLA for repeated SLA breaches.<\/p>\n<p>7) Reporting &amp; Reviews<\/p>\n<ul>\n<li>Monthly Reports: usage by department\/project, spend, incidents, cancellations, on-time<\/li>\n<\/ul>\n<p>pickup %, CO\u2082 estimates.<\/p>\n<ul>\n<li>Quarterly Business Reviews (QBRs): performance vs. KPIs, user feedback, improvement plan,<\/li>\n<\/ul>\n<p>and innovation updates.<\/p>\n<ul>\n<li>Ad-hoc Reports: on request for audits, donor reporting, or management needs.8) Pricing &amp; Payment Terms<\/li>\n<li>Pricing should be competitive and inclusive of all applicable fees (e.g., platform, booking,<\/li>\n<\/ul>\n<p>waiting, tolls).<\/p>\n<ul>\n<li>Discounts: indicate corporate\/volume discounts and any loyalty benefits.<\/li>\n<li>Invoicing: monthly consolidated, itemized by rider\/department\/project with trip IDs, dates,<\/li>\n<\/ul>\n<p>routes, and costs.<\/p>\n<ul>\n<li>Payment Terms: Net 30 days from receipt of valid invoice and supporting documents.<\/li>\n<li>Taxes: invoices must comply with applicable tax laws and show relevant tax identifiers.<\/li>\n<\/ul>\n<p>8) Eligibility &amp; Mandatory Requirements<\/p>\n<p>Vendors must submit evidence of the following (mandatory, non-scored unless stated):<\/p>\n<ul>\n<li>Valid business registration and operating licenses for transport services.<\/li>\n<li>Proof of insurance coverage (passenger liability + comprehensive motor).<\/li>\n<li>Demonstrated corporate client experience (\u2265 3 references).<\/li>\n<li>Data protection compliance statement and DPA readiness.<\/li>\n<li>Acceptance (or annotated markup) of FAWE\u2019s key SLA\/KPI framework.<\/li>\n<li>Signed Conflict of Interest and Anti-Bribery declarations (Annexes).<\/li>\n<\/ul>\n<p>9) Evaluation &amp; Selection Criteria<\/p>\n<p>Stage 1: Mandatory Compliance (Pass\/Fail)<\/p>\n<ul>\n<li>All documents in Sections 4 and 9 are provided and compliant.<\/li>\n<\/ul>\n<p>Stage 2: Technical &amp; Financial Evaluation (Weighted)<\/p>\n<ul>\n<li>Technical Proposal \u2013 70%<\/li>\n<\/ul>\n<p>o Safety &amp; Compliance \u2013 20%<\/p>\n<p>o Technology, Security &amp; Reporting \u2013 15%<\/p>\n<p>o Fleet Quality &amp; Coverage \u2013 15%<\/p>\n<p>o Experience &amp; References \u2013 10%<\/p>\n<p>o Sustainability \u2013 10%<\/p>\n<ul>\n<li>Financial Proposal \u2013 30%<\/li>\n<\/ul>\n<p>o Total cost of ownership (fares, fees), clarity of pricing, and corporate discounts.<\/p>\n<p>FAWE may conduct presentations\/demos and site\/office verification before final award.11) Data Protection &amp; Confidentiality<\/p>\n<ul>\n<li>Provider must comply with applicable data protection laws (including the Kenya Data<\/li>\n<\/ul>\n<p>Protection Act, 2019, where applicable).<\/p>\n<ul>\n<li>A Data Processing Agreement (DPA) will form part of the contract.<\/li>\n<li>Personal data shall be used strictly for service provision, stored securely, retained minimally,<\/li>\n<\/ul>\n<p>and deleted upon instruction or contract termination.<\/p>\n<ul>\n<li>Provider must notify FAWE of any data breach without undue delay and cooperate on<\/li>\n<\/ul>\n<p>remediation.<\/p>\n<p>10) Ethical Conduct &amp; Safeguarding<\/p>\n<ul>\n<li>Adherence to FAWE\u2019s policies on anti-bribery and corruption, safeguarding,<\/li>\n<\/ul>\n<p>anti-harassment, non-discrimination, and related standards is required.<\/p>\n<ul>\n<li>The provider must ensure drivers maintain professional conduct and comply with FAWE\u2019s<\/li>\n<\/ul>\n<p>safeguarding expectations.<\/p>\n<p>11) Legal, Compliance &amp; Liability<\/p>\n<ul>\n<li>Compliance with applicable transport, labor, and occupational health &amp; safety regulations.<\/li>\n<li>The contract will be governed by applicable national law as specified at award, with<\/li>\n<\/ul>\n<p>venue\/jurisdiction indicated in the final agreement.<\/p>\n<ul>\n<li>The provider shall indemnify FAWE against third-party claims arising from provider<\/li>\n<\/ul>\n<p>negligence, non-compliance, or breach.<\/p>\n<p>12) Clarifications<\/p>\n<p>All clarification questions should be sent by email (see Section 16) no later than five (5) calendar days<\/p>\n<p>before the submission deadline.
